From PBS: The proposed USPS rule will ask states to provide the agency with a list of people who have requested a mail-in or absentee ballot for an election. "This provision will help determine adherence to federal law and facilitate law enforcement efforts," the proposed rule states.

The proposal cites President Donald Trump's March executive order that seeks to tighten mail voting rules and create eligible voter lists, even though the Constitution explicitly grants states the authority to run elections, while Congress has a limited oversight role in adopting election regulations. Despite the president's own use of mail ballots in past elections, he has called the voting method "cheating."

Legal Updates related to EO on Post Office

NAACP v. USPS, filed in the DC District Court, challenged the proposed regulation on the basis that it does not comply with the settlement of a 2020 lawsuit entered into by the parties. On July 1, Judge Sullivan issued a nationwide order blocking implementation of the proposed USPS rule on that basis. The government appealed on July 6.

State of California v. Trump is a multi-state lawsuit (23 states including Virginia and DC) alleging that the Executive Order violates the separation of powers and is unconstitutional. District Court Judge Talwani of the District of Massachusetts granted a motion for summary judgment on June 25 blocking implementation of the E.O. for all of the states that are plaintiffs and relating only to the 11/3/2026 election and any before that date. The 11 Republican Attorneys General who had intervened in the suit appealed on July 2 but were denied a stay pending appeal.

League of Women Voters v. Trump is filed in the same district as CA v. Trump with voting rights organizations as the plaintiffs. No ruling yet on their motion for a preliminary injunction.

The Democratic Party and its campaign arms filed suit in federal district court in DC on April 1 asking the court to permanently enjoin the Trump Administration from taking any steps to implement the E.O. The preliminary injunction was denied and the plaintiffs have appealed.

The 'SAVE' Act promotes the false idea that non-citizens are voting in great numbers.

The so-called 'SAVE Act' would require people to prove citizenship when registering or updating their voter registration, though proving citizenship will be hard for many citizens.
